Terms of Use – DrivePulse

These Terms of Use (“Terms”) govern your access to and use of the website, mobile applications, online platforms, facilities, content, products, and services (collectively, the “Services”) provided by DrivePulse (“DrivePulse,” “we,” “us,” or “our”). By accessing or using the Services, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with these Terms, you must not access or use the Services.

1. Eligibility and Acceptance
   You must be at least the age of majority in your province or territory of residence in Canada to use the Services, or have the consent of a parent or legal guardian. By using the Services, you represent that you have the legal capacity to enter into these Terms and to comply with all applicable laws.
2. Nature of Services
   DrivePulse provides fitness and wellness-related services that may include in-person and virtual fitness classes, group and individual training sessions, workout programs and exercise guidance, educational and informational content related to fitness, wellness, and lifestyle, and recommendations or promotions of third-party and affiliate products. All Services are provided for general fitness, educational, and informational purposes only.
3. No Medical Advice
   The Services do not constitute medical advice, diagnosis, or treatment. DrivePulse is not a medical provider or healthcare professional. Any information or guidance provided is general in nature and is not a substitute for professional medical advice. You are responsible for consulting a qualified healthcare professional before beginning any exercise or wellness program, particularly if you have any medical condition, injury, or health concern.
4. Assumption of Risk
   Participation in fitness activities involves inherent risks, including physical injury, illness, or discomfort. By using the Services, you voluntarily assume all risks associated with physical activity, whether known or unknown, and agree that DrivePulse is not responsible for any injuries, losses, or damages resulting from your participation.
5. Limitation of Liability
   To the maximum extent permitted by applicable Canadian law, DrivePulse, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services. This includes, without limitation, personal injury, loss of profits, loss of data, or business interruption.
6. Affiliate and Third-Party Products
   DrivePulse may promote or recommend third-party or affiliate products and services. DrivePulse does not manufacture, control, or guarantee these products or services and is not responsible for their quality, safety, legality, or performance. Any transactions you enter into with third parties are solely between you and the third party.
7. Intellectual Property
   All content made available through the Services, including text, graphics, logos, videos, programs, and materials, is owned by or licensed to DrivePulse and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or exploit any content without prior written permission from DrivePulse.
8. User Conduct
   You agree to use the Services lawfully and in a manner that does not violate applicable laws, infringe the rights of others, or interfere with the operation of the Services. DrivePulse reserves the right to suspend or terminate your access if you violate these Terms.
9. Privacy
   Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with applicable Canadian privacy laws.
10. Termination
    DrivePulse may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms or misuse the Services. Upon termination, all rights granted to you under these Terms will immediately cease.
11. Governing Law
    These Terms shall be governed by and interpreted in accordance with the laws of Canada and the applicable laws of the province or territory in which DrivePulse operates, without regard to conflict of law principles.
12. Changes to These Terms
    DrivePulse reserves the right to modify these Terms at any time. Updated Terms will be effective upon posting. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
